2) Data collection when you visit our website

When using our website for purely informational purposes, i.e. if you do not register or otherwise provide us with information, we only collect data that your browser transmits to our server (so-called "server log files"). When you visit our website, we collect the following data, which is technically necessary for us to display the website to you:

3) Hosting

Hosting by Shopify
We use the shop system of the service provider Shopify International Limited, Victoria Buildings, 2nd Floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland (“Shopify”), for the purpose of hosting and displaying the online shop based on processing on our behalf. 4) Cookies

In order to make your visit to our website attractive and to enable the use of certain functions, we use so-called cookies on various pages. These are small text files that are stored on your device. Some of the cookies we use are deleted again after the end of the browser session, i.e. after you close your browser (so-called session cookies). Other cookies remain on your device and enable us to recognize your browser on your next visit (so-called persistent cookies). If cookies are set, they collect and process certain user information such as browser and location data as well as IP address values to an individual extent. Persistent cookies are automatically deleted after a specified period, which may vary depending on the cookie. You can find out how long a particular cookie is stored in the overview of the cookie settings of your web browser.

In some cases, the cookies serve to simplify the ordering process by saving settings (e.g. remembering the contents of a virtual shopping cart for a later visit to the website). If personal data is also processed by individual cookies used by us, the processing is carried out in accordance with Art. 6 Para. 1 lit. b GDPR either for the execution of the contract, in accordance with Art. 6 Para. 1 lit. a GDPR in the event of consent or in accordance with Art. 6 Para. 1 lit. f GDPR to safeguard our legitimate interests in the best possible functionality of the website and a customer-friendly and effective design of the page visit.

Please note that you can set your browser so that you are informed about the setting of cookies and can decide individually whether to accept them or exclude the acceptance of cookies for certain cases or in general. 5) Contacting Us

When you contact us (e.g., via contact form or email), personal data is collected. The specific data collected in the case of a contact form is evident from the respective contact form. This data is stored and used exclusively for the purpose of responding to your request or for contacting you and the associated technical administration. The legal basis for the processing of this data is our legitimate interest in responding to your request in accordance with Art. 6 Para. 1 lit. f GDPR. If your contact aims at the conclusion of a contract, the additional legal basis for the processing is Art. 6 Para. 1 lit. b GDPR. Your data will be deleted after your request has been fully processed. This is the case when it can be inferred from the circumstances that the matter in question has been conclusively clarified and provided that there are no legal storage obligations to the contrary.

6) Data processing when opening a customer account and for contract processing

In accordance with Art. 6 Para. 1 lit. b GDPR, personal data will also be collected and processed if you provide it to us for the execution of a contract or when opening a customer account. The data collected is evident from the respective input forms. It is possible to delete your customer account at any time by sending a message to the aforementioned address of the controller. We store and use the data you provide for contract processing. After complete processing of the contract or deletion of your customer account, your data will be blocked with regard to tax and commercial law retention periods and deleted after these periods have expired, unless you have expressly consented to further use of your data or a legally permitted further data use has been reserved by us.

7) Use of customer data for direct advertising

7.1 Subscription to our email newsletter

If you subscribe to our email newsletter, we will send you regular information about our offers. The only mandatory information for sending the newsletter is your email address. The provision of further data is voluntary and will be used to address you personally. We use the so-called double opt-in procedure for sending the newsletter. This means that we will only send you an email newsletter if you have expressly confirmed that you consent to receiving newsletters. We will then send you a confirmation email asking you to confirm that you wish to receive the newsletter in the future by clicking on a corresponding link.

By activating the confirmation link, you give us your consent to use your personal data in accordance with Art. 6 Para. 1 lit. a GDPR. When you register for the newsletter, we save your IP address registered by the Internet service provider (ISP) as well as the date and time of registration in order to be able to trace any possible misuse of your email address at a later point in time. The data collected by us when registering for the newsletter will be used exclusively for advertising purposes by way of the newsletter. You can unsubscribe from the newsletter at any time via the link provided in the newsletter or by sending a corresponding message to the controller named at the beginning. After unsubscribing, your email address will be immediately deleted from our newsletter distribution list, unless you have expressly consented to further use of your data or we reserve the right to use data beyond this, which is permitted by law and about which we inform you in this declaration.

7.2 Newsletter dispatch via MailChimp
Our e-mail newsletters are sent via the technical service provider The Rocket Science Group, LLC d/b/a MailChimp, 675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA (http://www.mailchimp.com/), to whom we pass on the data you provided when registering for the newsletter. This transfer takes place in accordance with Art. 6 Para. 1 lit. f GDPR and serves our legitimate interest in using an effective, secure and user-friendly newsletter system. Please note that your data will generally be transferred to a MailChimp server in the USA and stored there.
MailChimp uses this information to send and statistically evaluate the newsletter on our behalf. For the evaluation, the e-mails sent contain so-called web beacons or tracking pixels, which represent single-pixel image files that are stored on our website. This makes it possible to determine whether a newsletter message has been opened and which links have been clicked. With the help of web beacons, Mailchimp automatically generates general, non-personal statistics about the response behavior to newsletter campaigns. On the basis of our legitimate interest in the statistical evaluation of newsletter campaigns to optimize advertising communication and better target recipient interests, the web beacons also collect data from the respective newsletter recipient (e-mail address, time of retrieval, IP address, browser type and operating system) in accordance with Art. 6 Para. 1 lit f GDPR and used. This data allows an individual conclusion to be drawn about the newsletter recipient and is processed by Mailchimp for the automated creation of statistics that recognize whether a specific recipient has opened a newsletter message.
If you want to deactivate the data analysis for statistical evaluation purposes, you must unsubscribe from the newsletter.
MailChimp can also use this data in accordance with Art. 6 Para. 1 lit. f GDPR itself on the basis of its own legitimate interest in the needs-based design and optimization of the service and for market research purposes, for example to determine from which countries the recipients come. However, MailChimp does not use the data of our newsletter recipients to contact them itself or pass them on to third parties.
To protect your data in the USA, we have concluded a data processing agreement (“Data-Processing-Agreement”) with MailChimp based on the standard contractual clauses of the European Commission to enable the transfer of your personal data to MailChimp. This data processing agreement can be viewed at the following internet address if you are interested: https://mailchimp.com/legal/data-processing-addendum/
You can view MailChimp's data protection regulations here:
https://mailchimp.com/legal/privacy/

7.3 Advertising by postal mail

Based on our legitimate interest in personalized direct advertising, we reserve the right to store your first and last name, your postal address and - if we have received this additional information from you as part of the contractual relationship - your title, academic degree, year of birth and your professional, industry or business name in accordance with Art. 6 Para. 1 lit. f GDPR and to use it for sending interesting offers and information about our products by postal mail.

You can object to the storage and use of your data for this purpose at any time by sending a corresponding message to the controller.

8) Data processing for order processing

8.1 To process your order, we work together with the following service providers who support us in whole or in part in the execution of concluded contracts. Certain personal data is transmitted to these service providers in accordance with the following information.

The personal data collected by us will be passed on to the transport company commissioned with the delivery within the scope of contract processing, insofar as this is necessary for the delivery of the goods. As part of the payment processing, we pass on your payment data to the commissioned credit institution, provided this is necessary for the payment processing. If payment service providers are used, we will inform you of this explicitly below. The legal basis for the transfer of data is Art. 6 Para. 1 lit. b GDPR.

8.2 To fulfill our contractual obligations to our customers, we work with external shipping partners. We will pass on your name and delivery address and, if required for delivery, your telephone number, exclusively for the purpose of delivering the goods Art. 6 Para. 1 lit. b GDPR to a shipping partner selected by us.

Your data will only be passed on to the extent that this is actually necessary for processing the order. Details on data protection at Billbee and its data protection declaration can be found on the Billbee website at "billbee.io".

8.4 Use of payment service providers (payment services)

- Apple Pay

Use of Youtube videos

This website uses the Youtube embedding function to display and play videos from the provider “Youtube”, which belongs to Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland (“Google”).

The extended data protection mode is used here, which, according to the provider, only initiates the storage of user information when the video(s) are played. If the playback of embedded Youtube videos is started, the provider “Youtube” uses cookies to collect information about user behavior. According to information from “Youtube”, these serve, among other things, to collect video statistics, improve user-friendliness and prevent abusive behavior. If you are logged in to Google, your data will be directly assigned to your account when you click on a video. If you do not want the assignment to your profile on YouTube, you must log out before activating the button. Google stores your data (even for users who are not logged in) as usage profiles and evaluates them. Such an evaluation takes place in particular according to Art. 6 Para. 1 lit. f GDPR on the basis of Google's legitimate interests in the display of personalized advertising, market research and/or the needs-based design of its website. You have the right to object to the creation of these user profiles, whereby you must contact YouTube to exercise this right. As part of the use of Youtube, personal data may also be transmitted to the servers of Google LLC. in the USA.
Regardless of whether the embedded videos are played, a connection to the Google network is established each time this website is accessed, which can trigger further data processing operations without our influence.

Further information on data protection at “YouTube” can be found in the provider's data protection declaration at: https://www.google.de/intl/de/policies/privacy

Insofar as legally required, we have obtained your consent to the processing of your data described above in accordance with Art. 6 Para. 1 lit. a GDPR. 10) Online Marketing

Use of Google Ads Conversion Tracking

This website uses the online advertising program "Google Ads" and, as part of Google Ads, conversion tracking from Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland ("Google"). We use Google Ads to draw attention to our attractive offers on external websites with the help of advertising materials (so-called Google Adwords). Based on the advertising campaign data, we can determine how successful the individual advertising measures are. We are pursuing the goal of showing you advertising that is of interest to you, making our website more interesting for you, and achieving a fair calculation of advertising costs.

The conversion tracking cookie is set when a user clicks on an ad placed by Google. Cookies are small text files that are stored on your device. These cookies usually expire after 30 days and are not used for personal identification. If the user visits certain pages of this website and the cookie has not yet expired, Google and we can recognize that the user clicked on the ad and was redirected to this page. Every Google Ads customer receives a different cookie. Cookies cannot therefore be tracked via the websites of Google Ads customers. The information collected with the help of the conversion cookie is used to create conversion statistics for Google Ads customers who have opted for conversion tracking. Customers see the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, they do not receive any information that can be used to personally identify users. If you do not wish to participate in tracking, you can block this usage by deactivating the Google Conversion Tracking cookie in your internet browser under the heading "User settings". As part of the use of Google Ads, personal data may also be transferred to the servers of Google LLC. in the USA.

In these exceptional cases, this processing takes place in accordance with Art. 6 Para. 1 lit. f GDPR on the basis of our legitimate interest in the statistical analysis of user behavior for optimization and marketing purposes.
On our behalf, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide us with other services relating to website and internet use. 13.2 Applications for job advertisements by e-mail

On our website, we advertise currently vacant positions in a separate section, for which interested parties can apply by e-mail to the contact address provided.

Inclusion in the application process requires that applicants provide us with all personal data required for a well-founded and informed assessment and selection together with their application by e-mail.
The required information includes general information about the person (name, address, a telephone or electronic contact option) as well as performance-specific evidence of the qualifications necessary for a position. If necessary, health-related information may also be required, which must be given special consideration under labor and social security law in the interest of the applicant's social protection.

The individual components that an application must contain to be considered and the form in which these components must be sent by e-mail can be found in the respective job advertisement.

After receipt of the application sent using the specified e-mail contact address, the applicant data will be stored by us and evaluated exclusively for the purpose of processing the application. For queries arising during processing, we will use either the e-mail address provided by the applicant with their application or a telephone number provided, at our discretion.

The legal basis for this processing, including contacting you with queries, is Art. 6 Para. 1 lit. b GDPR in conjunction with Section 26 Para. 1 BDSG, according to which the application process is regarded as the initiation of an employment contract.

To the extent that special categories of personal data within the meaning of Art. 9 Para. 1 GDPR (e.g. health data such as information about severe disability) are requested from applicants during the application process, the processing takes place in accordance with Art. 9 Para. 2 lit. b. GDPR, so that we can exercise the rights arising from labor law and social security and social protection law and fulfill our related obligations.

Cumulatively or alternatively, the processing of special categories of data can also be based on Art. 9 Para. 1 lit. h GDPR if it is carried out for the purposes of preventive health care or occupational medicine, for the assessment of the working capacity of the applicant, for medical diagnostics, the provision of care or treatment in the health or social sector or for the administration of systems and services in the health or social sector.

If the applicant is not selected in the course of the above-described evaluation or if an applicant withdraws their application prematurely, their data transmitted by e-mail and all electronic correspondence, including the original application e-mail, will be deleted after a corresponding notification at the latest after 6 months. This period is based on our legitimate interest in answering any follow-up questions about the application and, if necessary, being able to meet our obligations to provide evidence from the regulations on the equal treatment of applicants.

In the event of a successful application, the data provided will be further processed on the basis of Art. 6 Para. 1 lit. b GDPR in conjunction with Section 26 Para. 1 BDSG for the purposes of implementing the employment relationship.

14.1 The applicable data protection law grants you comprehensive rights as a data subject vis-à-vis the controller with regard to the processing of your personal data (rights to information and intervention), about which we inform you below:

  • Right to information in accordance with Art. 15 GDPR: In particular, you have the right to information about your personal data processed by us, the processing purposes, the categories of personal data processed, the recipients or categories of recipients to whom your data have been or will be disclosed, the planned storage period or the criteria for determining the storage period, the existence of a right to rectification, erasure, restriction of processing, objection to processing, complaint to a supervisory authority, the origin of your data if it was not collected from you by us, the existence of automated decision-making including profiling and, where applicable, meaningful information about the logic involved and the scope and intended effects of such processing concerning you, as well as your right to be informed of the guarantees pursuant to Art. 46 GDPR if your data is transferred to third countries;
  • Right to rectification in accordance with Art. 16 GDPR: You have the right to immediate rectification of incorrect data concerning you and/or completion of your incomplete data stored by us;
  • Right to erasure in accordance with Art. 17 GDPR: You have the right to demand the erasure of your personal data if the requirements of Art. 17 Para. 1 GDPR are met. However, this right does not exist in particular if the processing is necessary for exercising the right to freedom of expression and information, for fulfilling a legal obligation, for reasons of public interest or for asserting, exercising or defending legal claims;
  • Right to restriction of processing in accordance with Art. 18 GDPR: You have the right to demand the restriction of the processing of your personal data as long as the accuracy of your data contested by you is verified, if you refuse the erasure of your data due to unlawful data processing and instead demand the restriction of the processing of your data, if you need your data for the assertion, exercise or defense of legal claims after we no longer need this data after achieving the purpose or if you have lodged an objection for reasons of your particular situation, as long as it is not yet clear whether our legitimate reasons outweigh yours;

You have the right to be informed about these recipients.
  • Right to data portability according to Art. 20 GDPR: You have the right to receive the personal data that you have provided to us in a structured, common and machine-readable format or to request its transfer to another controller, provided this is technically feasible.
  • Right to withdraw consent according to Art. 7 para. 3 GDPR: You have the right to withdraw your consent to the processing of data at any time with effect for the future. In the event of withdrawal, we will immediately delete the data concerned, unless further processing can be based on a legal basis for processing without consent. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
  • Right to complain according to Art. 77 GDPR: If you believe that the processing of personal data concerning you violates the GDPR, you have the right to complain to a supervisory authority, in particular in the member state of your place of residence, your workplace or the place of the alleged violation, without prejudice to any other administrative or judicial remedy.

14.2 RIGHT TO OBJECT

IF, AS PART OF A BALANCING OF INTERESTS, WE PROCESS YOUR PERSONAL DATA ON THE BASIS OF OUR PREDOMINANT LEGITIMATE INTEREST, YOU HAVE THE RIGHT TO OBJECT TO THIS PROCESSING AT ANY TIME FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION WITH EFFECT FOR THE FUTURE.
IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL STOP PROCESSING THE DATA CONCERNED. HOWEVER, FURTHER PROCESSING REMAINS RESERVED IF WE CAN PROVE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING THAT OUTWEIGH YOUR INTERESTS, FUNDAMENTAL RIGHTS AND FREEDOMS, OR IF THE PROCESSING SERVES TO ASSERT, EXERCISE OR DEFEND LEGAL CLAIMS.

IF YOUR PERSONAL DATA IS PROCESSED BY US FOR DIRECT MARKETING PURPOSES, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH ADVERTISING. YOU CAN EXERCISE YOUR OBJECTION AS DESCRIBED ABOVE.

IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL STOP PROCESSING THE DATA CONCERNED FOR DIRECT MARKETING PURPOSES.

15) Duration of storage of personal data

The duration of the storage of personal data is based on the respective legal basis, the purpose of processing and – if applicable – additionally on the respective statutory retention period (e.g. retention periods under commercial and tax law).

When processing personal data on the basis of express consent in accordance with Art. 6 para. 1 lit. a GDPR, this data is stored until the data subject withdraws their consent.

If statutory retention periods exist for data that is processed within the framework of legal or quasi-legal obligations on the basis of Art. 6 para. 1 lit. b GDPR, this data will be routinely deleted after expiry of the retention periods, provided that it is no longer required for contract fulfillment or contract initiation and/or we no longer have a legitimate interest in its continued storage.

When processing personal data on the basis of Art. 6 para. 1 lit. f GDPR, this data is stored until the data subject exercises their right to object under Art. 21 para. 1 GDPR, unless we can demonstrate compelling legitimate grounds for the processing that outweigh the interests, rights and freedoms of the data subject, or the processing serves to assert, exercise or defend legal claims.

When processing personal data for the purpose of direct marketing on the basis of Art. 6 para. 1 lit. f GDPR, this data is stored until the data subject exercises their right to object under Art. 21 para. 2 GDPR.

Unless otherwise stated in the other information in this declaration about specific processing situations, stored personal data will otherwise be deleted when it is no longer necessary for the purposes for which it was collected or otherwise processed.
